By accessing and using the Flashcards World website, mobile application, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") provided by Flashcards World SL. If you do not agree to these Terms, please do not use the Service.

2. Age Restrictions

The Service is not intended for individuals under the age of 13. By using the Service, you represent and warrant that you are at least 13 years of age. If you are under 18, you may use the Service only with the involvement of a parent or guardian.

3. Use License & Restrictions

Permission is granted to use Flashcards World for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title. Under this license, you may not:

  • Modify or copy the materials for commercial purposes;
  • Attempt to decompile or reverse engineer any software contained on the Service;
  • Remove any copyright or other proprietary notations from the materials; or
  • Transfer the materials to another person or "mirror" the materials on any other server.

4. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. User Generated Content & Copyright Policy

Our Service allows you to create, store, and share flashcards and other content ("User Content"). You retain ownership of any intellectual property rights that you hold in that User Content.

When you upload, submit, store, send or receive content to or through our Service, you give Flashcards World a worldwide license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content.

Copyright Infringement: We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes the copyright or other intellectual property infringement of any person. If you are a copyright owner and believe that your work has been copied in a way that constitutes copyright infringement, please submit your claim via email to [email protected].

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law;
  • Harassing, threatening, or defrauding other users;
  • Posting content that is infringing, libelous, defamatory, obscene, pornographic, abusive, or offensive;
  • Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service;
  • Uploading invalid data, viruses, worms, or other software agents through the Service.

7. Third-Party Links and Ads

The Service may contain links to third-party websites or services (including advertisements) that are not owned or controlled by Flashcards World. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Flashcards World shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

9. Fees and Payments

The Service offers both free and premium features. Standard features are available at no cost. Premium subscriptions and one-time purchases provide access to additional features such as unlimited AI flashcard generation (subject to the fair-use terms in Section 10), ad-free experience, and enhanced study tools.

Payments are processed through the Apple App Store (iOS), Google Play Store (Android), or directly through our website. All prices are displayed before purchase. Subscription terms and renewal details are shown at the point of purchase and managed through your app store account settings.

10. AI-Generated Content

The Service includes an AI-powered flashcard generation feature. By using this feature, you agree to the additional AI Terms of Use. AI-generated content is provided as-is and may contain inaccuracies. You are responsible for reviewing and verifying all AI-generated flashcard content before use.

When you use AI features, your prompt text is sent to third-party AI service providers for processing. We do not use your prompts to train AI models. See our Privacy Policy for details on how AI data is handled.

Fair use of AI generation. "Unlimited" AI flashcard generation is provided for normal, individual study use. To keep the feature fast and available for everyone, we may apply reasonable rate limits and other technical safeguards. We may throttle, suspend, or terminate access to AI generation for any account that engages in automated, scripted, bulk, resale, or otherwise excessive or abusive use, or any use that places an unreasonable load on our systems or our third-party AI providers.

11. Intellectual Property Rights

The Service and its original content (excluding User Content provided by users), features, and functionality are and will remain the exclusive property of Flashcards World and its licensors.

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the app settings.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FLASHCARDS WORLD MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THEIR SERVICES, OR THE INFORMATION, CONTENT OR MATERIALS INCLUDED THEREIN. THIS DISCLAIMER DOES NOT AFFECT YOUR STATUTORY RIGHTS AS A CONSUMER UNDER APPLICABLE EU LAW.

14. Limitation of Liability

IN NO EVENT SHALL FLASHCARDS WORLD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

15. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of Spain. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Spain. If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence. Nothing in these Terms affects your rights as a consumer under mandatory consumer protection legislation in your country of residence.

16. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
